THE AGREEMENT:

1. Based upon photograph(s), templates, field measurements, and/or other such information provided by the Customer, as well as the Customers initial deposit of $100.00,  Classic Glass Studios (CGS) proposes to develop a Preliminary Design Pattern and Cost Estimate Sheet for the creation of an original Stained Glass Panel;
2. Upon completion of the Preliminary Design Pattern, CGS agrees to forward the Preliminary Design Pattern and Cost Estimate Sheet to the Customer for approval.  Cost Estimate Sheet is to include the recommended panel size, glass colors and types and estimated cost of the finished Stained Glass Panel. Upon final approval, the Preliminary Design Pattern and Cost Estimate Sheet will become a part of this Agreement;
3. Upon receipt of the Preliminary Design Pattern and Cost Estimate Sheet, Customer is to approve the Preliminary Design Pattern, and Cost Estimate Sheet “as is”, or provide CGS with desired modifications.  In the event that modification to the Preliminary Design Patten Pattern and Cost Estimate Sheet is requested by the Customer, an amended Preliminary Design Pattern and Cost Estimate Sheet will be crafted to reflect the desired changes.  The amended Preliminary Design Pattern and Cost Estimate Sheet will be forwarded to the Customer for final approval.  CGS reserves the right to charge the Customer for any additional costs as a result of time and materials necessary for modification to the original Preliminary Design and Cost Estimate Sheet;
4. Upon final approval, the Customer agrees to pay CGS 50% of the agreed upon costs, as indicated on the Cost Estimate Sheet.  Upon receipt of the 50% deposit, CGS agrees to begin construction of the Stained Glass Panel;
5. Upon completion of the Stained Glass Panel, CGS agrees to forward all work products, including all photograph(s), design patterns, and templates created and utilized in the creation and construction of the Stained Glass Panel.  Upon receipt of all photograph[ph(s), design patterns, and templates Customer agrees to forward to Classic Glass 25% of the agreed upon costs, as indicated on the Cost Estimate Sheet;
6. Once CGS receives the required 25% of agreed upon costs, (bring total paid to 75% of approved final costs), CGS will present the finished Stained Glass Panel to the Customer. In the event that shipping of the finished Stained Glass Panel is required, Customer  agrees to pay all shipping and handling costs directly to CSG;
7. Upon receipt of the finished Stained Glass Panel, and final invoice, Customer agrees to pay in full, all balance due from original approved costs, plus shipping and handling costs (if applicable), and any additional costs associated with modification to the original Preliminary Design Pattern, and Cost Estimate Sheet;
8. Customer understands that all work product provided is restricted, and agrees that the work product associated with the Stained Glass Panel is not to be provided to other artist for duplication in the use of a Stained Glass Panel, and is to remain the sole property of CGS; and,
9. In the event the Customer wishes to terminate this Agreement prior to commencement of construction of the Stained Glass Panel, the Customer agrees to forfeit any original deposits, made to CGS, and pay any additional design costs which may be associated with development of the work product.  Additionally, should the Customer, for any reason, wish to terminate this Agreement following Final Approval of the Preliminary Design Pattern and Cost Estimate Sheet, all monies and / or deposits will be forfeited, and any additional design costs which may be associated with development of the work product will be paid by the Customer.
